In a construction defect case, the cost estimator is retained by the client. Depending on the case, (single family homes, condominiums, etc.) the client also retains other experts such as architects, electrical, civil, plumbing, mechanical, structural, geotechnical engineers, etc. After these experts complete their analyses regarding the existence of potential construction defects, they prepare individual reports. These reports summarize their field observations, testing, possible construction code violations, etc. Based on their analyses, recommendations of repair are provided to the cost estimator. I have prepared hundreds of estimates during my career of almost thirty (30) years. These estimates have totaled in excess of $600 million. I have been deposed approximately seventy five (75) times. All of the depositions were for projects located in California and Nevada which I had been retained as a cost-estimating expert. All cases involved every discipline of construction. I have testified in four trials, two as a cost-estimating expert. One case involved geotechnical issues. The other one involved architectural issues |
